Terms of Service

These Terms of Service (“Terms”) govern your access to and use of esigna (the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use esigna. Contact us at support@esigna.app.

esigna lets you design email signatures and optionally generate AI bobblehead avatars. Designing, saving, and exporting signatures is generally available without payment. Avatar generation uses credits from free allowances and/or purchased credit packs.

• You must provide accurate account information and keep it up to date
• You are responsible for activity under your account and for keeping your sign-in secure
• You must be old enough to form a binding contract in your location (and at least 13)
• We may suspend or terminate accounts that violate these Terms or create risk for the Service or other users

You agree not to:

• Upload photos or content you do not have the rights to use
• Use the Service to create illegal, harmful, deceptive, or abusive content
• Attempt to reverse engineer, scrape, overload, or disrupt the Service
• Circumvent credit limits, rate limits, authentication, or billing controls
• Misrepresent your identity or affiliation when using avatars or signatures
• Use the Service in a way that violates applicable law or third-party rights

You retain ownership of the content you submit (such as photos and signature details). You grant us a limited license to host, process, display, and generate derivatives (including bobblehead avatars) as needed to operate and improve the Service you request.

You are solely responsible for how you use generated avatars and exported signatures outside esigna.

• Credit packs are one-time digital purchases for avatar generation (and related generation features we describe at checkout)
• Credits are tied to your account, have no cash value, and are not transferable
• Prices and pack sizes are shown at checkout and may change for future purchases
• Payments are processed by Dodo Payments as Merchant of Record
• Refunds and credit reversals are described in our Refund Policy

Avatar generation relies on third-party AI systems. Outputs can vary, may be imperfect, and are provided as-is. We do not guarantee a specific likeness, style consistency across regenerations, or uninterrupted availability of any AI model.

The Service integrates providers such as Clerk (authentication), Supabase (data), Vercel (hosting), Dodo Payments (checkout), and AI image providers. Their terms and privacy practices apply to their processing. Email clients and other tools where you paste signatures are outside our control.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESIGNA AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR CREDIT PACKS IN THE 3 MONTHS BEFORE THE CLAIM OR (B) USD $50.

You agree to defend and indemnify us against claims arising from your content, your use of the Service, or your violation of these Terms or applicable law.

We may update these Terms by posting a revised version with a new “Last updated” date. We may modify or discontinue parts of the Service. You may stop using esigna at any time. Provisions that should survive (including ownership, disclaimers, limitations, and indemnity) will survive termination.

These Terms are governed by the laws applicable where the operator of esigna is located, without regard to conflict-of-law rules. Courts in that jurisdiction will have exclusive venue for disputes that cannot be resolved informally, except where prohibited by law.
